Terms of Service

These Terms of Service ("Terms") govern your use of mikum.me (the "Service"), which is operated by MIKUM-ME INC ("MIKUM-ME", "we", "us", or "our"). Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data and is incorporated into these Terms by reference. We've tried to keep them short and readable. By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, please don't use the Service.
The Service
mikum.me lets you create photo-based arrival guides for locations and share them via a public link. You can build a guide from photos or by uploading a short video we sample frames from, mark up photos with arrows, circles, and labels, add an address, map pin, parking notes, and contact details, and publish it. Related features include directories (hubs that group several guides), translations, open counts and simple statistics for your guides, gifting or transferring a guide to someone else, optional custom branding, an embeddable widget for your own website, and optional verification that reveals a door or access code only after a visitor confirms they are at the location or is approved by you or a contact you designate. Some features are Premium-only, and reasonable usage limits (including rate limits on AI features) may apply. We may add, change, or remove features over time.
Eligibility & your account
You must be at least 16 years old to use the Service. You may browse or start a guide as a temporary guest before signing up; to publish a guide, you must create an account using email, a phone number, or a Google or Apple sign-in. You are responsible for the activity under your account and for keeping your email, phone, or sign-in provider secure. You agree to provide accurate information and to keep it up to date.
Your content
You keep ownership of the photos, text, and other content you upload ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt (for example, resizing images or generating draft text), and display Your Content solely to operate, secure, and improve the Service, including publicly displaying guides you choose to publish. You are responsible for Your Content and confirm you have the rights needed to upload and share it.
Host responsibilities
If you create and share guides through the Service, you are responsible for:
- Accuracy. Ensuring that all directions, photos, annotations, and instructions in your guides are accurate and complete to the best of your knowledge.
- Authorization. Publishing guides only for locations you have the right to include, share, or grant access to.
- Maintenance. Promptly updating or removing guides when information becomes outdated, inaccurate, or unsafe.
- Safety. Not publishing guides that may direct visitors into dangerous, illegal, inaccessible, or privately-restricted locations without appropriate authorization.
By publishing a guide, you represent that you have the right to share the information it contains, and you acknowledge that visitors may rely on it for physical navigation.
Visitor responsibilities
If you use the Service as a visitor opening a shared guide link, you agree to:
- Independent judgment. Make your own independent assessment of whether any route, direction, location, or instruction is safe and appropriate for you before acting on it.
- No redistribution. Not republish, redistribute, or publicly share guide content beyond its intended audience without the guide owner's explicit permission.
- Legal compliance. Comply with all applicable local laws, including trespass laws, traffic regulations, and property-access restrictions, when following any guide.
- Risk acknowledgment. Guides are user-generated and may be incomplete, inaccurate, or outdated. You rely on guide information at your own risk.
AI features
Some features use artificial intelligence to help you build a guide: for example, drafting step directions, suggesting annotations, or translating your guide. When you use these features, the relevant content (such as photos, short video frames, and text) is sent to our AI provider to generate suggestions. AI output can be inaccurate or incomplete; you are responsible for reviewing and editing suggestions before you publish. Do not rely on AI output as a substitute for your own judgment.
Phone verification & SMS
If you sign in or verify your account with a phone number, you consent to receive a one-time verification code by SMS. These messages are for security and account verification, not marketing.
Separately, when you add and confirm a mobile number in mikum.me (your own number, or an approval contact you designate for a gate/door code), you agree to receive transactional text messages from mikum.me at that number: gate-code approval requests (when a visitor at your gate asks for the code) and one-time number-verification links. Each number is confirmed by a double opt-in: it only receives these messages after you tap the verification link we text to it. We do not send marketing or promotional texts, and we never sell or share your number.
Message frequency varies with activity, and message and data rates may apply depending on your carrier and plan. Reply STOP to unsubscribe or HELPfor help, and you can remove any number at any time in your account settings.
Gate codes & approval requests
If you add a door, gate, or access code to a guide, you can keep it hidden and choose how it is revealed: after an on-site location check, or after you (or an approval contact you designate) approve a request. Approving a request reveals every gated code for that location to that visitor, and a visitor who requests a code shares their name (plus their organization and a "verified" marker if they are signed in) with the contacts you designated, by SMS.
You are responsible for the codes you add and for who you designate: only add a number as an approval contact if that person has agreed to receive these texts, and only add a code you are allowed to share. Visitors must not request codes for locations they have no legitimate reason to enter, and must not use the request feature repeatedly to pressure or harass an owner or contact.
Acceptable use
You agree not to use the Service to:
- upload or share unlawful, infringing, deceptive, or harmful content;
- publish another person's address, entrance details, door or access codes, or contact information without their permission;
- violate anyone's privacy, publicity, intellectual-property, or other rights;
- impersonate any person or organization, or misrepresent your affiliation;
- upload malware, or attempt to disrupt, overload, or gain unauthorized access to the Service or its infrastructure;
- scrape, harvest, or bulk-collect data from the Service, or reverse engineer it, except where the law permits;
- circumvent usage limits, security, or access controls (including the free-plan guide limit, rate limits, or a code-reveal gate);
- add someone's phone number as an approval or contact number without their permission, or use the Service to track, stalk, or surveil anyone; or
- use the Service to send spam or for any illegal or abusive purpose.
Gifting & transferring guides
The Service lets you generate a time-limited link to transfer ownership of a guide to another person. When someone accepts a transfer, ownership moves to their account and you no longer control that guide. Only transfer guides you own, and only to people you intend to give them to.
Plans, billing & cancellation
The Service offers a free plan (which includes a limited number of published guides) and a paid subscription ("Premium"), billed monthly or annually. Paid plans are billed on a recurring basis through our payment processor, Stripe, and renew automatically at the then-current price until cancelled. You can cancel at any time from your account's billing portal; cancellation stops future charges and takes effect at the end of the current billing period, and deleting your account also cancels your subscription. Prices, taxes, and plan features may change, and we'll give notice of material changes. Except where required by law or as described under "Termination by us" below, payments are non-refundable. If a payment fails or a subscription ends, guides beyond the free-plan limit may be unpublished until you upgrade again or remove some.
Embedding & directories
You may embed a guide you published on a website you control, using the embed link we provide. Don't remove or obscure the mikum.me mark shown in the embed unless your plan includes white-label branding. Directories let you group guides you own under one page; you remain responsible for every guide you add to a directory.
Advertising
Guides published on the free plan may display third-party advertising. Premium removes advertising from your guides.
Third-party services & links
The Service relies on third parties to operate, including hosting, authentication, storage, payment processing, SMS delivery, maps and address lookup, AI processing, and (on free-plan guides) advertising. Guides also link out to third-party navigation apps such as Google Maps, Waze, and Apple Maps, which open on the viewer's device. We don't control these third parties and aren't responsible for them; your use of them is subject to their own terms and policies. See our Privacy Policy for the providers we use.
Our intellectual property
The Service itself, including the mikum.me name, logo, software, and design, belongs to MIKUM-ME INC and its licensors. These Terms don't grant you any right to use our branding except as needed to use the Service normally.
Reporting infringing or unsafe content
If you believe a guide infringes your rights, discloses your private location or access details without permission, or otherwise violates these Terms, email us at support@mikum.me with the link and details. We may remove content and unpublish or disable guides that we believe violate these Terms or applicable law.
Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, and we do not guarantee that it will be uninterrupted or error-free.
Safety Disclaimer
THE SERVICE PROVIDES INFORMATIONAL GUIDES AND NAVIGATION DIRECTIONS ONLY. NAVIGATION AND PHYSICAL ACCESS TO LOCATIONS INVOLVE INHERENT RISKS, INCLUDING BUT NOT LIMITED TO RISK OF PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE. BY USING THE SERVICE, YOU EXPRESSLY ASSUME ALL SUCH RISKS.
MIKUM-ME INC DOES NOT WARRANT THAT ANY ROUTE, DIRECTION, LOCATION, OR GUIDE IS SAFE, LEGAL, ACCURATE, ACCESSIBLE, OR FREE FROM HAZARDS. GUIDE CONTENT IS USER-GENERATED AND MAY BE INCOMPLETE, INACCURATE, OR OUTDATED. YOU ARE SOLELY RESPONSIBLE FOR INDEPENDENTLY ASSESSING CONDITIONS, COMPLYING WITH APPLICABLE LAWS (INCLUDING TRESPASS LAWS AND ACCESS RESTRICTIONS), AND EXERCISING YOUR OWN JUDGMENT ABOUT WHETHER ANY LOCATION OR ROUTE IS APPROPRIATE FOR YOU BEFORE ACCESSING IT.
Code-reveal verification features (on-site location checks and owner-approval requests) are convenience measures to limit casual exposure of a code; they are not a security or access-control system, can be affected by device, GPS, or network conditions, and should not be relied on to protect a sensitive code.
THE EMERGENCY ACCESS CODE FEATURE IS AN INFORMATIONAL CONVENIENCE ONLY. IT DOES NOT SUMMON, ALERT, OR REACH ANY EMERGENCY SERVICE, IT IS NOT GUARANTEED TO BE AVAILABLE OR TO WORK WHEN IT IS NEEDED, AND IT MUST NEVER BE USED IN PLACE OF CALLING THE EMERGENCY SERVICES AND DESCRIBING HOW TO REACH THE LOCATION YOURSELF. SEE Emergency access codes ABOVE.
Limitation of liability
To the maximum extent permitted by law, MIKUM-ME INC and its affiliates, officers, and operators will not be liable for any indirect, incidental, special, or consequential damages.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF:
(A) THE TOTAL AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR
(B) USD $50 (FIFTY US DOLLARS).
THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS ITS ESSENTIAL PURPOSE.
Indemnification
You agree to indemnify and hold harmless MIKUM-ME INC and its affiliates, officers, and operators from claims, damages, and costs (including reasonable legal fees) arising out of Your Content or your misuse of the Service or violation of these Terms or others' rights.
Termination
You may stop using the Service at any time, and you can delete your account yourself from your account settings. Deletion is permanent: it cancels any active subscription, removes your guides and their photos, and cannot be undone.
When you permanently delete your account, all guides you have created, including any published guides and previously shared links, will be permanently deactivated. Visitors who attempt to open a shared link after your account is deleted will see a notice that the guide is no longer available. Account deletion is irreversible; we recommend unpublishing or transferring guide ownership (see "Gifting & transferring guides" above) before deleting your account.
Sections that by their nature should survive termination (such as content license for already-shared material, disclaimers, liability limits, and indemnity) will continue to apply.
Termination by us
We may suspend or terminate your access to the Service at any time if you violate these Terms or engage in conduct that harms other users, the Service, or us.
Free plan. We may terminate or suspend a free account at any time, for any reason or no reason, without prior notice or liability.
Paid (Premium) plan. If we terminate a paid account without cause (that is, for reasons other than a violation of these Terms), we will give you at least 21 days' advance written notice by email to your registered address. During this notice period, you may continue using the Service and export your content. We will pro-rate and refund any prepaid subscription fees covering the period after the termination date.
Governing law & disputes
These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws rules, and any dispute will be handled by the state or federal courts located in New York County, New York, unless applicable law requires otherwise. Before filing a claim, please contact us so we can try to resolve it informally.
Israeli users. If you are located in Israel, the following applies in addition to the general governing-law provisions above:
- Your use of the Service is subject to the Israeli Consumer Protection Law, 5741-1981 and its regulations, regardless of any choice-of-law clause in these Terms.
- The Protection of Privacy Law, 5741-1981 (as amended, including Amendment 13) applies to the processing of your personal data.
- Nothing in these Terms limits any mandatory rights you have under Israeli law.
- The courts of Tel Aviv-Jaffa have non-exclusive jurisdiction over disputes arising from your use of the Service in Israel, in addition to any jurisdiction specified above.
Language
These Terms may also be published in other languages. Any such translation is provided for convenience and is intended to be consistent with this English version. In the event of any conflict, inconsistency, or difference of interpretation between a translation and this version, this English version governs, except where applicable law requires otherwise.
Changes to these Terms
We may update these Terms from time to time. If we make material changes (such as changes that significantly expand our rights, reduce your rights, or alter core features of the Service), we will give you at least 30 days' advance notice before the changes take effect, either by email to your registered address or by a prominent notice within the Service.
For non-material changes (such as typographical corrections or clarifications that do not affect your rights), we may update the Terms without advance notice and will update the "Last updated" date at the top of this page.
Continued use of the Service after the effective date of any update constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and may delete your account before the effective date.
